Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Photoboothify mobile application and website at photoboothify.com (the "Service"), operated by Melrose Lab ("we," "us," or "our"). Please read these Terms carefully before using the Service.

1. Acceptance of Terms

By creating an account or using Photoboothify, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. We may modify these Terms at any time, and your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

2. Account Registration and Responsibilities

To use certain features of Photoboothify, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Promptly update your information if it changes
• Accept responsibility for all activity that occurs under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

3. Acceptable Use

You agree not to use Photoboothify to:

• Upload, share, or distribute illegal, obscene, or harmful content
• Harass, bully, threaten, or intimidate other users
• Infringe upon the intellectual property rights of others
• Upload content depicting minors in inappropriate situations
• Distribute malware, viruses, or other harmful software
• Attempt to gain unauthorized access to other accounts or systems
• Use the Service for any unlawful purpose
• Scrape, crawl, or use automated means to access the Service without permission
• Impersonate another person or entity
• Interfere with or disrupt the Service or its infrastructure

We reserve the right to remove content and suspend or terminate accounts that violate these guidelines at our sole discretion.

4. Marketplace Terms

Photoboothify includes a marketplace feature that allows users to list and browse photo booth equipment for rent. By using the marketplace, you acknowledge and agree to the following:

4.1 For Vendors (Equipment Listers)

• You are solely responsible for the accuracy of your listings, including descriptions, pricing, availability, and images
• You must have the legal right to rent out any equipment you list
• You are responsible for the condition and safety of your equipment
• Photoboothify does not guarantee any bookings or rental income

4.2 For Renters

• You are responsible for verifying equipment suitability before booking
• You agree to use rented equipment responsibly and return it in the condition received
• Any disputes regarding equipment condition or rental terms are between you and the vendor

4.3 Platform Role

Photoboothify acts solely as an informational platform connecting vendors and renters. We are not a party to any rental agreement between users. We do not guarantee the quality, safety, legality, or availability of any listed equipment. We do not mediate disputes between vendors and renters, though we may provide assistance at our discretion.

5. Intellectual Property

5.1 Your Content

You retain all ownership rights to photos, videos, and other content you create or upload through Photoboothify. By uploading content, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Service (e.g., storing your photos, generating thumbnails, enabling QR code sharing).

5.2 Our Platform

Photoboothify, including its design, code, features, branding, logos, and documentation, is the intellectual property of Melrose Lab. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written permission.

5.3 Frames and Filters

Pre-made frames and filters provided within the app are licensed to you for personal, non-commercial use within the Service. You may use them in your photos and share those photos freely, but you may not extract, redistribute, or sell the frame/filter assets themselves.

6. AI-Generated Content

Photoboothify offers AI-powered frame generation using OpenAI technology. By using this feature, you acknowledge:

• AI-generated frames are created based on text prompts you provide
• You are solely responsible for the content of your prompts
• You agree not to use prompts that generate illegal, harmful, offensive, or infringing content
• AI-generated outputs may not always be accurate, appropriate, or as expected
• We reserve the right to filter or reject prompts that violate our acceptable use guidelines
• You may use AI-generated frames in your photos for personal and commercial purposes

7. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied
• We do not warrant that the Service will be uninterrupted, error-free, or secure
• We are not liable for any loss of data, including photos or videos, due to technical failures
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater

You acknowledge that you use the Service at your own risk and are responsible for maintaining backups of your important content.

8. Indemnification

You agree to indemnify and hold harmless Melrose Lab, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

9. Termination

We may suspend or terminate your account at any time if:

• You violate these Terms or our acceptable use guidelines
• Your account is used for fraudulent or illegal activity
• We are required to do so by law
• We discontinue the Service (with reasonable notice)

You may delete your account at any time through the app settings or by contacting us at support@photoboothify.com. Upon termination, your right to use the Service ceases immediately. We may retain certain data as described in our Privacy Policy.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of the United States. You agree to submit to the personal jurisdiction of such courts.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

12. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Melrose Lab regarding the Service and supersede any prior agreements.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting a notice within the app or sending a notification. Changes become effective when posted unless otherwise specified. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
